Event |Silent War— the author of 《The American Trap》Frederic Pierucci meet-up with Chinese readers

 

At present, international trade is carried out in complicated forms and global economic development is under huge pressure. Enterprises are facing more intense competition in the global market. Chinese enterprises are also facing many challenges after over 30 years of rapid development of Chinese economy. 10 years ago, the Ministry of Commerce of the People’s Republic of China encouraged Chinese enterprises to go out. With the promotion of the national strategy of the “Belt and Road”, more state-owned and private enterprises will go out to conduct trade, undertake the construction of projects, participate in bidding and tendering, participate in the projects of the World Bank and carry out other activities in the countries along the “Belt and Road”.

However, Chinese enterprises may not be fully aware of risks they face when they compete in the global market. As shown by several cases in recent years, Chinese enterprises are increasingly aware of the risks and challenges faced by enterprises and senior executives. At the end of 2018, the relevant ministries and commissions of China issued relevant guidelines and standards for urging enterprises to perform business compliance when developing overseas. Chinese enterprises should strengthen compliance system construction and implement the systems to observe law and discipline and protect their interests.

In this context, Fred Pierucci, the author of The American Trap, will meet with Chinese readers. With his own experience, the case of Alstom, his study of FCPA of the United States and other relevant laws, the living example of his colleagues and himself actively promoting the establishment of Sapin II in France, and so forth, Mr. Fred Pierucci will provide Chinese enterprises with analysis, practice, cases (not just Alstom), experience and solutions.

Fred Pierucci(BSc ENSMA- MBA Columbia Business School- INSEAD) is a former Senior Executive of Alstom with a wide international experience having lived and worked in China, the USA, Algeria, the UK, Switzerland and France during his 22 year career with the company.

Up to mid-2013, he headed, from Singapore, the global Euro 1.4 bn – 4000 people Alstom Boiler Business, with major operations in China, Germany, France, India and the USA. 

During a business trip to the United States in 2013, he was arrested by the FBI at New York’s JFK airport as he was getting off the plane, for having participated in alleged facts of corruption in Indonesia to secure a $60 million contract for Alstom in 2003.

He then spent several months in a high security jail in Rhode Island, USA during which time he studied in depth the US Foreign Corrupt Practices Act (FCPA) and how it was applied by the US Department of Justice and Security & Exchange Commission (DOJ/SEC) to companies and individuals. He was finally released on a $1.5 million bail package.

Using this unique experience and expertise, he created in 2015 IKARIAN, a consulting company whose aim is to assist and advise its clients regarding the challenges companies and their leaders face to comply with the Foreign Corruption Practice Act (FCPA), the UK Bribery Act (UKBA), “Sapin 2” law and other anti-corruption laws or norms such as the ISO 37001.

 About “The American trap” 

The American Trap is a best-selling financial book in the EU and China in 2019. In this book, the author introduces a very dramatic and real business story based on his personal experience. The book has two main lines. In the first line, the author describes the hostile and dangerous environment he faced when he was arrested by FBI at JFK International Airport and imprisoned in a prison for detaining prisoners subject to severe punishment, and also introduces his psychological journey from an executive to a prisoner and the pain, fear, anger, disappointment, despair and so forth he suffered in emotion. In the other line, the author introduces his experience of Alstom, where he worked, paying bribes in several countries to obtain projects and being investigated by the U.S. Department of Justice; senior executives being chased; being forced to return to the negotiation table; and finally cooperating, pleading guilty and paying the largest amount of fine in the history of FCPA. At last, Alstom had 70% of its business acquired by GE. In the book, the author also introduces FCPA (Foreign Corrupt Practices Act) and plea bargaining in the U.S. judicial system and procedures. With intersection of these two main lines, this book introduces the more macro background of the influence of the United States on French stakeholders, the contest of different political forces within the French bureaucracy, and that the French government finally realized the interest “damage” of its national strategic industries and enterprises and started to take actions to promote the final legislation in the anti-corruption field and formulate strategies and rules to protect its industries and enterprise interests.

The book has been sold well in the EU and become one of the must-read books for MBA and law school students. CITIC Press introduced and published it in China in June. Since then, this book has become one of the best sellers of CITIC in 2019 and was rated as one of the best-selling books at the heavyweight Shenzhen Book Fair.
